Surrogacy or how to “purchase” American nationality?

In the United States, since the Immigration and Nationality Act, the granting of citizenship was reserved to genetic parents only. However, a recent amendment to the immigration policy has just altered the definitions of “mother” and “parents” to include surrogate mothers.

 

Thus a baby born to an American surrogate mother and whose intended parents are of another nationality, can be granted American nationality. Although advocates of this approach aim to compensate for a “legal loophole”, this opening in the law raises opposition and is not without a negative effect – it allows people to indirectly “purchase” American nationality for a child born through surrogacy.
