Restrictions on commercial surrogacy in india: americans want to collect their embryos

A request has been filed with the Mumbai High Court by two American couples wishing to collect their embryos held by a hospital in the city. These requests have been made following recent restrictions imposed on commercial surrogacy by the Indian Government  (see GPA en Inde : des restrictions à l’ordre du jour– surrogacy in India: restrictions in the pipeline).

 

The Mumbai High Court has asked the Indian Union to find a solution and to view the problem from a “humane” perspective. The Court deems that this “extraordinary situation” has been compounded by several changes in Indian law regarding commercial surrogacy. The legal ruling will be given during the hearing which is scheduled for 24 October 2016.
