Israel: granting “right to have a grandchild”?

Publié le : 20 November 2013

An Israeli couple have been granted permission to use the sperm of their dead son, who died in 2010 at the age of 27, to fertilise a surrogate mother. The couple will be the beneficiaries of the procedure since the court recognised their desire to have a grandchild as "the aspiration to satisfy the deepest and most fundamental desires of man".

The couple won their case after 3 years of legal battles during which they presented a "contract signed with a surrogate mother unknown to their son".  Attorney-general Yehuda Einstein nevertheless "recommended a social enquiry into the couple" and indicated that final conclusions would take their son’s presumed wishes into account.
