In India: “right of the foetus” vs. abortion?

In India, abortion is authorised up to 20 weeks. A young 18 year-old Indian woman, who was 27 weeks pregnant following rape, requested permission to have an abortion, believing that “she would suffer permanent mental trauma if required to give birth”.

On 6 September, the young girl’s case was heard before a Special Hospital Commission which decreed that an abortion would place the young girl’s life in danger. The judges added that, in this case, the young girl was not the only individual involved since “this also concerns the rights of the foetus”.
